Terms of Service

Welcome to PolaroidKu ("PolaroidKu", "we", "us", or "our"). These Terms of Service ("Terms") constitute a legally binding agreement between you (whether as an event host, event organizer, attendee, guest, or platform visitor: "User", "Host", "Guest", or "you") and PolaroidKu.

By accessing or using our website, scanning an event QR code, uploading photographs or audio messages, or purchasing an event upgrade, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, Refund & Cancellation Policy, and Digital Delivery & Shipping Policy. If you do not agree, you must immediately discontinue use of the platform.

1. Eligibility & Account Security

To create an event or purchase an upgrade on PolaroidKu, you must be at least 18 years of age or possess legal capacity under the laws of Malaysia or your home jurisdiction. If you are under the legal age, you may only use PolaroidKu with the express consent and supervision of a parent or legal guardian.

• Host Accounts: Hosts must provide accurate, current, and complete information during registration. You are solely responsible for maintaining the confidentiality of your credentials and all activities occurring under your account.
• Guest Access: Event guests may upload photographs and voice wishes without creating a personal account by scanning the host's event QR code or accessing the unique event link. Guests are individually responsible for ensuring their submissions comply with these Terms.
• Unauthorized Use: You must immediately notify PolaroidKu at support@polaroidku.com upon discovering any unauthorized access or security breach involving your event or account.

2. Description of Digital Guestbook Services

PolaroidKu provides an interactive, cloud-based digital photo guestbook application designed for weddings, birthdays, corporate dinners, galas, and social gatherings. Platform capabilities include:

• Mobile Web Guestbook: Browser-based photo capture and upload for guests without requiring mobile application installations.
• Custom Photo Frames & Borders: Interactive canvas rendering of branded Polaroid frames, event dates, and couple/host names.
• Live Event Slideshow: Real-time, fullscreen ballroom projector slideshow displaying approved guest memories dynamically.
• Voice Wishes & Audio Notes: High-fidelity digital voice recording attached to guest photo submissions (on supported tiers).
• Bulk Archive Downloads: High-resolution ZIP archive generation for event hosts to preserve their memories.

Purely Digital Service: PolaroidKu is exclusively an online software service. We do not provide physical photo booths, on-site personnel, paper prints, physical Polaroid film, or postal courier delivery.

3. Event Plans, Pricing & One-Time Upgrades

PolaroidKu provides a tiered pricing model with transparent allowances in Malaysian Ringgit (MYR). All paid tiers are one-time purchases per individual event - we do not operate recurring monthly subscriptions or auto-debit renewals.

Prices are clearly displayed prior to checkout. Feature activation takes place automatically online as soon as payment is confirmed by our payment gateway.

4. Payments & Financial Processing (CHIP Gateway)

All transactions on PolaroidKu are processed securely via CHIP (Chip In Asia), a licensed payment gateway compliant with Malaysian banking standards.

• Supported Payment Channels: FPX online banking (Maybank2u, CIMB Clicks, Public Bank, RHB, Hong Leong Bank, etc.), credit and debit cards (Visa, Mastercard), and supported mobile e-wallets.
• Zero Card Storage: PolaroidKu never collects, processes, or stores your credit card numbers, CVVs, or bank credentials. All financial credentials are handled directly within CHIP's encrypted payment environment.
• Taxes & Invoicing: Prices shown include all applicable taxes unless explicitly stated otherwise. Digital transaction summaries and receipts are generated in your dashboard.
• Refunds: For duplicate charges or service non-delivery, please consult our Refund & Cancellation Policy.

5. Intellectual Property & 100% User Ownership

We believe your memories belong to you. Our intellectual property policy reflects absolute respect for user creativity:

• Your Ownership: You and your guests retain 100% ownership, copyright, and all moral rights in and to all photographs, captions, audio wishes, and media submitted to PolaroidKu.
• Limited Technical License: By uploading media, you grant PolaroidKu a strictly limited, non-exclusive, royalty-free, worldwide license solely to store, resize, composite with selected borders, generate thumbnails, cache, and display your media to fulfill platform functionality for your event during the active retention window.
• Strict No-AI & No-Sale Guarantee: PolaroidKu will never sell, monetize, rent, or transfer your personal photographs to third-party advertisers, data brokers, or commercial entities. We will never use your private event photographs or voice notes to train artificial intelligence (AI) models or machine learning algorithms.
• PolaroidKu Property: All platform code, software architectures, algorithms, graphics, brand marks, and default frame design assets remain the exclusive intellectual property of PolaroidKu.

6. Media Storage Limits & Lifecycle Retention

Because PolaroidKu serves events of all sizes, storage resources are governed by clear retention schedules to maintain platform performance and protect data privacy:

• Infrastructure: All media files are hosted on enterprise-grade Cloudflare R2 object storage with multi-region redundancy and encryption at rest.
• Retention Lifecycles: Media files remain accessible for downloading and viewing for exactly the retention duration associated with your plan (7 days for Free, 14 days for Premium, 30 days for Pro) counting from the event date or plan activation.
• Host Obligation to Download: It is the sole responsibility of the event host to download their high-resolution ZIP archive before the event's retention period expires.
• Automated Permanent Purge: Upon expiration of the retention window, automated maintenance services permanently queue and delete all event media files from object storage. Expired media cannot be recovered once purged.

7. Acceptable Use & Content Moderation

To maintain a safe, welcoming, and lawful environment for all celebrations, you agree not to submit or permit the submission of content that:

• Is unlawful, defamatory, libelous, fraudulent, obscene, pornographic, or sexually explicit;
• Promotes violence, discrimination, hatred, or harassment against any individual or group;
• Infringes upon any third party's copyright, trademark, privacy, or publicity rights;
• Contains software viruses, malware, trojans, or automated scripts intended to disrupt platform infrastructure;
• Attempts to circumvent event photo quotas, bypass payment flows, or reverse-engineer PolaroidKu software.

Moderation Rights: Hosts have access to event moderation tools to delete unwanted guest uploads. PolaroidKu reserves the right, but assumes no obligation, to remove any content or terminate access to any event that violates these standards without prior notice or refund.

8. Service Availability & Network Realities

PolaroidKu is designed for high reliability and scale. However, the service is provided on an "AS IS" and "AS AVAILABLE" basis.

• Venue Internet Connectivity: PolaroidKu operates over the public internet. Real-time guest uploads and live slideshow feeds require active mobile data or Wi-Fi connectivity at your event venue. PolaroidKu is not liable for performance issues caused by venue network dead zones, captive portal firewalls, or cellular congestion.
• Maintenance Windows: We strive to schedule platform maintenance during off-peak hours. Critical security patches and cloud provider updates may occasionally cause brief momentary interruptions.

9. Limitation of Liability

To the maximum extent permitted by applicable laws of Malaysia, including the Consumer Protection Act 1999:

• In no event shall PolaroidKu, its directors, developers, employees, or partners be liable for any indirect, incidental, punitive, special, or consequential damages, including loss of profits, loss of data, loss of goodwill, or emotional distress arising from the use or inability to use the platform.
• PolaroidKu's total aggregate liability arising out of or related to these Terms, whether in contract, tort (including negligence), or otherwise, shall not exceed the total monetary amount actually paid by you to PolaroidKu for the specific event upgrade giving rise to the claim (capped at RM89 for Pro or RM39 for Premium).

10. Indemnification

You agree to defend, indemnify, and hold harmless PolaroidKu, its affiliates, officers, and employees against any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) resulting from: (a) your use of the platform; (b) any content uploaded by you or your guests; (c) your violation of these Terms; or (d) your infringement of any third party's rights.

11. Governing Law & Dispute Resolution

These Terms shall be governed by, construed, and enforced in accordance with the laws of Malaysia, without giving effect to conflict of law principles.

In the event of any controversy, claim, or dispute arising out of or relating to these Terms, the parties agree to first attempt resolution through good-faith informal negotiations. If the dispute remains unresolved within thirty (30) days, the parties irrevocably submit to the exclusive jurisdiction of the competent courts of Malaysia.

12. Modifications to Terms

PolaroidKu reserves the right to amend or update these Terms periodically to reflect changes in legal statutes, technology, or platform features. The date at the top of this document indicates the most recent revision. Your continued use of the platform following the publication of updated Terms constitutes your binding acceptance.
